Personal Use question

Here's a question for all you designers - for 'personal use' items, can I create pages to give away as long as money is not involved? I've been asked to volunteer my services for creating 'Life Books' (similar to scrapbooks, but - never mind - it's not important here) for kids. It's a purely volunteer thing, but it could involve advertising down the road. I'd hate to be 2 years into a project only to discover that I've been breaking copyright I didn't fully understand.

Hello!
There is not a lot of designers that allow making free things with their PU products smiley
I began a list of these designers allowing making freebies:
Charly Renay designs
A Simply Sassy Scrap Creation
Becky’s Creations (35%)
Blue Butterfly Designs
Jenny’s Designz
But, sometimes, you are surprised, because they change their TOU. So you have to read their TOU each time you purchase a kit.
It happened 3 times for me, i asked designer by mail, their reply they allow making free things with their kits and then, several weeks after, I read their TOUs and in their new Tous, it was written they don't allow making freebies with their kits, not very cool because you purchased their kits and you can't do nothing with!

Hope with this thread we can know other nice designers. smiley

Calleigh, are you asking the Pixel Scrapper designers or the designers in general?

I guess both... I use a lot of Pixel Scrapper stuff, but I also have a ton of stuff from others.

If you give away the albums to the kids that's okay for PU license. But for example if you make this albums for an institution that will charge an amount of money from the kids to give the album than that means you need a commercial use license.
And most of designers wouldn't allow to make quick pages with their personal use license since that means the pages can be used several times rather than making custom design for each person. But I think this is not the case for the pixel scrapper tou. What is important is you do not make this professionally and the people you give away the albums would not sell them.

Sorry to hijack the thread, but I have a similar question.

Am I able to use graphics and kits from Pixel Scrapper and post my finished pages on my blog to showcase what I have made, but without giving anything away or selling anything? smiley

[Edited by Jordan Magnuson to show latest version of our license]

Our TOU says like this:

Personal Use License
This license is intended for personal use that does not generate income, and is not related to your profession.

Please Do:

  • Use the item however you want for personal use (personal craft projects, etc.).
  • Attribution is not required (though always appreciated).

Please Do Not:

  • Use the item for commercial purposes (anything where you make money, or related to your profession).
  • Distribute the item directly to others (refer them to the item's Pixel Scrapper download page instead).
  • Sell or distribute any digital files that you make with the item (though it is fine to post/display the craft projects you have made!).

--------
So yes you can showcase your work on your blog and submit to galleries. Hope that helps.
I am sure Marisa Lerin will explain it better but I think she has no time at the moment.

And you can see the TOU here> www.pixelscrapper.com/tou and look at frequently asked questions.

Thanks for this clarification, Elif. I was worried that the personal use license I was downloading precluded me from sharing newly remixed items here on Pixelscrapper or posting my finished pages on galleries to share with others. So confusing and so much to learn regarding these licenses!

Thanks for answering Elif! We try to keep our TOU simple, but there are so many things involved that it gets tricky. I'll see if we can get something added about sharing in galleries, and blogs. Sharing finished layouts wherever you'd like to do so is greatly encouraged!

Sorry for the confusion around licensing. We want to making things as simple as possible, but it's hard to avoid confusions. smiley

Thanks Elif for posting the PU license text! The text you originally posted was actually from an older version of our TOU. The current version reads as follows:

-----------------------------------

Personal Use License
This license is intended for personal use that does not generate income, and is not related to your profession.

Please Do:

  • Use the item however you want for personal use (personal craft projects, etc.).
  • Attribution is not required (though always appreciated).

Please Do Not:

  • Use the item for commercial purposes (anything where you make money, or related to your profession).
  • Distribute the item directly to others (refer them to the item's Pixel Scrapper download page instead).
  • Sell or distribute any digital files that you make with the item (though it is fine to post/display the craft projects you have made!).

-----------------------------------

So it is absolutely fine to share the finished crafts/layouts/etc that you make with PU products in galleries and things of that nature. But you should not distribute the products themselves, or "remixes" of the products.

If you are making something for others that involves or might involve generating income of any kind, then you should use the CU license. I hope that helps clarify things a little bit!

Please see the complete wording of our PU and CU licenses at https://www.pixelscrapper.com/tou

Thanks, Jordan, for the clarification!
